General Terms and Conditions
The completion of the electronic (online) registration or registration by other means to the educational events ("event") organized by BIOMODEL ("organizing secretariat") (“BIOMODEL", a company under Swiss law) concludes a contract ("Contract") between the person or company ("participant") registering and BIOMODEL. The present General Terms and Conditions ("GTC") are applicable to this contract. By registering, the participant declares that is aware of and accepts these GTC (which are available online).
Exclusion of liability
Changes to the programme
The event programme is correct at the time of publication. The organizing secretariat reserves the right to its sole discretion and without prior notice, to change or delete items in the programme, the schedule and/or other other aspects of the event. The organizing secretariat also reserves the right to reschedule or cancel the event. The organizing secretariat, the event direction and any third parties commissioned to carry out the event (e.g. the host organisation) are not liable either contractually or extra-contractually for direct or indirect, incidental or consequential damage, loss of earnings or inconvenience incurred by the participant as a result of changes, deletions, displacement or cancellation.
Non-performance or defective performance of the contract
The contractual and extra-contractual liability of the organizing secretariat, the direction and any third parties commissioned to carry out the event is excluded to the extent permitted by law. The contractual and extra-contractual liability is excluded in particular in cases of ordinary or slight negligence. The organizing secretariat, the direction and any third parties commissioned to carry out the event (e.g. the host organisation, online payment services, etc.) are not liable for any indirect, incidental or consequential damage, loss of profit or inconvenience incurred by the participant as a result of the non-performance or imperfect performance of the contract.
Corporate participation
A special ‘corporate’ registration fee may be offered to companies that wish to participate and be present during the event for networking purposes. Their participation is limited to one person, being the company representative, and includes the presence of the company logo in the final program. No other facilities are included. Any further facilities and arrangements are at the discretion of the organizing secretariat and should be discussed and agreed only with the organizing secretariat, since any event is related to education and training and is deemed independent of any other interest, commercial or other.
Force Majeure
The organizing secretariat, the event direction and any third parties commissioned to carry out the event are not in default and are not liable either contractually or extra-contractually for the non-performance or contract when this is due to an incident that cannot be controlled by them or their contractors, suppliers or subcontractors, including the following incidents: force majeure, total or partial destruction of production facilities or sites, war or civil insurrection, revolutions, administrative orders and actions, terrorist acts, fire, epidemics and pandemics, quarantine measures, extreme weather conditions, embargoes or trade restrictions, or other incident considered as force majeure according to international practice ("force majeure event").
IF THE EVENT IS CANCELLED DUE TO A FORCE MAJEURE EVENT, THE PARTICIPANT IS NOT ENTITLED TO A REFUND OF REGISTRATION OR ENTRY FEES OR COMPARABLE SERVICES. IF THE EVENT HAS TO BE MOVED DUE TO FORCE MAJEURE AND THE PARTICIPANT IS UNABLE OR UNWILLING TO ATTEND ON THE REPLACEMENT DATE, IS ALSO NOT ENTITLED TO A REFUND OF THE REGISTRATION OR ENTRY FEE OR COMPARABLE SERVICES.
Purpose of data collection
The organizing secretariat process all personal data in accordance with applicable law.
Your personal data must be collected, stored and processed for your registration to the event.
The data collected during the event registration will only be used for the purpose of planning and carrying out the event and will only be passed on to third parties directly involved in the realisation of the event, and only to the extent necessary for the organisational process (e.g. hotel).
The organizing secretariat will provide you with information about similar events, unless you refuse this at the time of registration.
Information and media
The organizing secretariat plans to film and photograph the event in order to use these recordings for its training, information or publicity material in print, electronic or other media, including its own. All material is the property of the organizing secretariat. By participating in the event, you authorise the organizing secretariat to use these photos/videos for such purposes. Only officially mandated organisers and journalists may take photo and audiovisual material. Any person who takes a photo or film without prior authorisation from the organizing secretariat or consent in writing (with personal video/audio equipment, mobile phone, digital camera/camera camera, recorder or similar) will be asked to stop using these devices immediately. The organizing secretariat accepts no responsibility.
Insurance
The registration fee does not include insurance.
We recommend that you take out insurance when registering for the event and when making your travel arrangements.
The policy should include:
- loss of fees/down payment due to cancellation of participation in the event or cancellation of the event itself
- loss of national/international flight and hotel costs following cancellation for any reason,
- failure to participate in guided tours or use pre-booked arrangements due to airline delays, strikes,
etc. airline delays, strikes, force majeure or other reasons,
- medical expenses (including health and accident insurance),
- loss of or damage to personal property,
- additional costs and repatriation if travel arrangements have to be changed.
The organizing secretariat accepts no responsibility for participants who have not taken out their own insurance in their home country.
Cancellation of participation
Cancellations must be sent in writing by e-mail to the organizing secretariat.
The registration fee will be refunded as follows:
More than 90 days before the first day of the event: 50% refund
Less or equal to 90 days before the first day of the event: no refund
If the event is held both onsite and online, registered participants or partners can switch to online participation.
The same cancellation conditions apply.
Applicable law and place of jurisdiction
The legal relationship resulting from the contract between the participant and the organizing secretariat is governed exclusively by the Swiss law to the exclusion of the rules of conflict of laws. The application of the United Nations Convention on Contracts for the International Sale of Goods of 11 April 1980 (Viennese Purchase Law) is expressly excluded. The courts at the headquarters of BIOMODEL, in Sion, Switzerland, shall have exclusive jurisdiction in the event of a dispute between the participant and the organizing secretariat. In the event of different interpretations between the original text and a translation, only the original English version of the GTC is authoritative. Should one or more provisions of these conditions be inapplicable, this shall not affect the validity of the other provisions. The parties shall replace the unenforceable provision with an enforceable applicable provision that comes as close as possible to the intended economic purpose. This also applies to any deficiencies.
